1. Scope and contracting party
These terms apply to web hosting, domains, email, website and software development, maintenance, reselling, support, office/print services and expressly ordered add-ons. The legal supplier and billing entity are identified in the order and legal notice.
2. Contract formation and documents
A contract is formed only through the configured acceptance or electronic signature flow, or by an express order confirmation. The immutable order snapshot records plan, price, term, region and options.
- Order snapshot and individual specification
- Customer service agreement
- SLA and support profile
- Registry/registrar terms where relevant
- Data processing agreement where processing is performed on behalf of the customer
3. Services, dependencies and customer cooperation
ClearlyHost provides the agreed technical service and does not promise a particular commercial outcome. Delivery dates depend on timely payment, access, content, approvals and other customer inputs. Third-party or customer-caused delay may reasonably move dependent milestones.
4. Prices, taxes and billing
The amounts and currency in the order snapshot govern. Taxes, public charges, registry fees and third-party costs are handled under the applicable contract and law. Price changes do not retroactively alter already-paid fixed service periods.
5. Acceptable use and security
Services may only be used lawfully and in line with the AUP. Customers remain responsible for secure credentials, endpoints, user roles and their own applications. ClearlyHost may take proportionate emergency measures where infrastructure, customers or third parties face an immediate risk.
6. Domains and third parties
Domain registrations depend on availability and registry/registrar rules. ClearlyHost may act as a reseller or intermediary. The registrant remains responsible for entitlement, accurate contact details, renewal and lawful use.
7. Term, renewal and termination
The contract term and renewal method are set out in the order. Automatic renewal only applies if expressly shown in the order snapshot and validly agreed under applicable law. Exit and data export follow the customer agreement.
8. Liability, force majeure and mandatory rules
Any contractual limitation of liability applies only to the extent permitted by law. Intentional misconduct and other non-excludable liabilities remain unaffected. Events outside reasonable control are handled under the force majeure clause.
9. Choice of law and international customers
Moroccan law may be selected as governing law where legally permissible. That choice does not remove mandatory protections that would apply notwithstanding the choice, including applicable consumer protections.
10. Electronic communications and evidence
Orders, acceptances and agreements may be documented electronically. Evidence may include document version, timestamp, IP address, account identifier, hash and audit trail. A qualified electronic signature is only claimed where an appropriate trust service is explicitly integrated.
11. Several services on one invoice
Several expressly ordered services may be billed together in one currency to the same invoice recipient. Each line specifies the service, quantity, unit price and, where relevant, the domain, reference and service period. Different recipients or incompatible tax treatments are not combined. Bundling alone does not create an additional renewal or immediate activation; previously issued invoices are not overwritten.
